{"id":18579,"date":"2018-01-13T17:47:14","date_gmt":"2018-01-13T17:47:14","guid":{"rendered":"http:\/\/watchmanmedia.org\/?p=18579"},"modified":"2018-01-14T18:56:01","modified_gmt":"2018-01-14T18:56:01","slug":"home-education-and-the-safeguarding-bandwagon","status":"publish","type":"post","link":"https:\/\/watchmanmedia.org\/?p=18579","title":{"rendered":"Home Education And The Safeguarding Bandwagon"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-18585\" src=\"https:\/\/watchmanmedia.org\/wp-content\/uploads\/2018\/01\/education-1-2.jpg\" alt=\"\" width=\"943\" height=\"448\" srcset=\"https:\/\/watchmanmedia.org\/wp-content\/uploads\/2018\/01\/education-1-2.jpg 943w, https:\/\/watchmanmedia.org\/wp-content\/uploads\/2018\/01\/education-1-2-300x143.jpg 300w, https:\/\/watchmanmedia.org\/wp-content\/uploads\/2018\/01\/education-1-2-768x365.jpg 768w\" sizes=\"auto, (max-width: 943px) 100vw, 943px\" \/>The safeguarding bandwagon in relation to home education rolled on throughout the Christmas break. <a href=\"http:\/\/www.walesonline.co.uk\/news\/education\/parents-home-educating-children-wales-14110054\" target=\"_blank\" rel=\"noopener\"><span style=\"color: #0000ff;\">Wales<\/span><\/a> announced \u00a0consultation on compulsory registration \u2013 the significance of which was missed by the national media.<\/p>\n<p>Eleanor Schooling, Ofsted\u2019s National Director of Social Care, published an <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.gov.uk\/government\/speeches\/social-care-commentary-hidden-children-the-challenges-of-safeguarding-children-who-are-not-attending-school\" target=\"_blank\" rel=\"noopener\">article<\/a> <\/span>on more effective safeguarding for home educated children \u2013 a thinly veiled attempt to coerce the government to agree to compulsory registration, which hung in the ether and appeared to have no purpose.<\/p>\n<p>Hackney Council was next to jump on the bandwagon, publishing an <a href=\"http:\/\/www.bbc.co.uk\/news\/education-42580792\" target=\"_blank\" rel=\"noopener\"><span style=\"color: #0000ff;\">article<\/span><\/a> on unregistered educational settings (UES) in its borough. The report focuses exclusively on Jewish yeshivas and laments the lack of government urgency in introducing compulsory registration and in giving local authorities powers to inspect home education. The argument goes that because these settings are unregistered, they constitute home education and all home educators must therefore be controlled.<\/p>\n<p>Having no education expertise but never a lobby group to miss an opportunity, Humanists UK weighed in, contributing to the report and adding to calls to control Jewish education. They took much of the credit for the Hackney report, presenting themselves as leaders of the national campaign against religious schools and, in passing, accusing Jewish schools of child abuse.<\/p>\n<p>Why is the bandwagon gathering such momentum? Probably because those who want complete control of every child in the country under the guise of safeguarding sense that they may be losing the argument.<\/p>\n<p>In a <a href=\"https:\/\/www.theyworkforyou.com\/wrans\/?id=2017-12-19.HL4335.h&amp;s=Education+section%3Awrans\" target=\"_blank\" rel=\"noopener\"><span style=\"color: #0000ff;\">written answer<\/span><\/a>, Lord Agnew (who recently replaced Lord Nash as Under-Secretary of State for Education) not only says that there will be no new legislative powers, he uses Amanda Spielman\u2019s own comments on Ofsted\u2019s success in dealing with UES to prove that existing legislation is effective.<\/p>\n<p>He even states that there are far fewer unregistered schools than at first estimated. That\u2019s not what supporters of Lord Soley\u2019s private members bill wanted to hear.<\/p>\n<p>Lord Soley\u2019s bill aims to tighten controls on home education; it received its second reading in November. Adopting a warm, avuncular tone, Lord Soley says he wants to help home educators, as they are a much neglected group, often unsupported and with unacknowledged needs. That\u2019s the warm, cuddly bit.<\/p>\n<p>The truth is a little more ominous. He wants to balance the rights of the child against the rights of the parents, even though home educating parents are discharging their duty and responsibility, not exercising their rights.<\/p>\n<p>In his <a href=\"https:\/\/hansard.parliament.uk\/Lords\/2017-11-24\/debates\/141D7347-083E-4EAF-9927-AD5283998B76\/HomeEducation%28DutyOfLocalAuthorities%29Bill%28HL%29\" target=\"_blank\" rel=\"noopener\"><span style=\"color: #0000ff;\">speech,<\/span><\/a> he thanks local authorities, two in particular, for their help in preparing the bill. And an FOI request to one of those authorities reveals, via <a href=\"https:\/\/edyourself.wordpress.com\/2018\/01\/09\/correspondence-various-las-lord-soley-home-education-bill\/\" target=\"_blank\" rel=\"noopener\"><span style=\"color: #0000ff;\">transcribed emails,<\/span><\/a> what that help actually looks like.<\/p>\n<p><strong>On the elective home education (EHE) lobby:<\/strong><em><br \/>\n<\/em><\/p>\n<blockquote><p><span style=\"color: #000000;\"><em>You are correct the EHE lobby is mobilising \u2013 already FOI requests\u2026asking for copies of all emails between officers and yourself.\u2019<\/em><\/span><\/p><\/blockquote>\n<p><span style=\"color: #000000;\"><strong>On what they want to achieve<em>:<\/em><\/strong> <\/span><\/p>\n<blockquote>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><em>Gov view is that LA\u2019s need to stretch the guidance and they want case law to be tested\u2019\u2026\u2019 Problem is that this needs to be communicated to EHE community\u2019.\u2018That\u2019s basically the trouble with all of this. Too much relies on parental permission\u2019. \u2018The core issues then are to establish clear statutory access to the children and having full details of all EHE\u2019s\u2019. \u2018Hopefully our collective efforts will influence the DfE\u2019s thinking.<\/em><\/span><\/p>\n<\/blockquote>\n<p><strong>On removing the words \u2018emotional and physical development\u2019 from the proposed wording in order to get legislation past the home ed lobby<\/strong><em>:<br \/>\n<\/em><\/p>\n<blockquote>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><em>The starting point is to get access to educational provision. Looking at provision is firmer ground than trying to tackle emotional development\u2019, \u2018words \u201cphysical and emotional\u201d could be left out not least because this will distract and allow the EHE lobby to be critical. The important issue is the duty to monitor the child\u2019s \u201ceducational\u2019 development\u201d\u2019 <\/em><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><em>Once EHE professionals are under duty to monitor the \u201ceducational\u2019 development\u201d of the child by a visit to the home and a discussion with the parent and child, they will be in a better position to detect any safeguarding issues\u2019 \u2018the starting point is to get access to educational provision. Looking at provision is firmer ground than trying to tackle emotional development.<\/em><\/span><\/p>\n<\/blockquote>\n<p><strong>Lord Soley\u2019s concern over the possible role of Lord Agnew:<\/strong><\/p>\n<blockquote>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><em>I understand the new Minister is S T A [Sir Theo Agnew] \u2013 is that correct? The other problem here is the position of the new minister on this issue. If he is still sympathetic to co-operating with me on getting the Bill into a form that satisfies the Government and myself then obviously I will try and involve the Department at all stages. If there is not a willingness to co-operate then I will have to reconsider how I handle the Bill. Any ideas about this?<\/em><\/span><\/p>\n<\/blockquote>\n<p><strong>On sanctions for non-compliant parents:<\/strong><\/p>\n<blockquote>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><em>Where a new statutory duty is created it is usual and good practice to create a sanction for non-compliance with the duty\u2026[include] a provision that makes clear that where a parent fails to register a Local Authority may take this into account in determining whether to issue a notice under the Education Act 1996\u2026case law has established that \u201cif parents refuse to answer it could very easily conclude that prima facie the parents were in breach of their duty.<\/em><\/span><\/p>\n<\/blockquote>\n<p>Lord Soley ends one email by saying that he needs to work out \u2018<em>how best to enlist public support as the opposition is now growing\u2019. <\/em>Oddly, I thought that was what living in democracy meant \u2013 legislation can be both proposed and opposed. Clearly he has temporarily lost sight of how democracy works.<\/p>\n<p>He also observes that opposition is \u2018<em>still far less than it was some years ago\u2019. <\/em>Watch this space, Lord Soley and make no assumptions about using your power to get \u2018clear statutory access\u2019 to other people\u2019s children.
